Terms and Conditions of WAYA
Welcome to WAYA..
By using the Waya Product & Services, YOU AGREE TO BE BOUND BY ITS CONDITIONS OF USE (explained below), Privacy Policy and all disclaimers and terms and conditions that appear elsewhere on the Waya Platform references to Waya Product & Services herein referred to as Waya as a product of Grup Waya Ghana Limited and Waya Limited UK.

Waya reserves the right to make changes to all Waya Product & Services and its:

  1. Conditions of Use,
  2. Privacy Policy,
  3. Refund Policy, and
  4. Chargeback Policy, at any time.

Each time you use any Waya Product & Services, you should visit and review the then current Conditions of Use, Privacy and Refund that apply to your transactions and use of Waya Product & Services.

If you are dissatisfied with Waya Product & Services, its content or Conditions of Use, you agree that your sole and exclusive remedy is to discontinue using Waya Product & Services.

Tampering with Waya Product & Services, misrepresenting the identity of a user, or conducting fraudulent activities on Waya Product & Services is prohibited.

Disclaimer and Limitation of Liability

By using Waya Product & Services, you expressly agree that use of Waya Product & Services is at your sole risk. Waya Product & Services is provided on an "as is" and "as available" basis. Neither Waya, nor any of its associates, including but not limited to its directors, employees, agents, designers, contractors, merchants (collectively, "Associates") warrant that use of Waya Product & Services will be uninterrupted or error-free.

Under no circumstances shall Waya or its Associates be liable for any direct, indirect, incidental, special or consequential damages that result from your use of or inability to use Waya Product & Services, including but not limited to your reliance, on any information obtained from Waya Product & Services that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any failure of performance.

The foregoing limitation shall apply in any action, whether in contract, tort or any other claim, even if an authorized representative of Waya has been advised of or should have knowledge of the possibility of such damages. You hereby acknowledge that this paragraph shall apply to all content, merchandise and services available through Waya.

Pricing Policy

Waya charges its users (clients & customers) a service fee/user fee/commission for providing to them, access and use of its product and services. Other services may be offered at face value with no additional charge from Waya. Said fees & charges are subject to change.

Paying for our Products & Services

Waya charges users for use of its products & services through multiple options as it facilitates money transfers, payments to merchants and receiving of payments as merchant.

These charges are agreed percentages which as a user of Waya Product & Services, are deducted or added on to your use of Waya Product and Services.

These occur through but are not limited to Visa®, MasterCard®, MTN mobile money®, Airtel money® and Tigo cash®.

Since all charges are electronic and most charges occur digitally, credit and debit cards are generally charged at the time you make a payment or initiate an order.

Validating Your Money Transfer or Payments

After you initiate a money transfer or payment or place an order using our product and services, we will validate the information you give us, by verifying your method of payment. We reserve the right to reject any payment you initiate and/or money transfer you make, and/or to limit quantities on any money transfer or payments, without giving any reason.

If we reject your money transfer or payment, we will attempt to notify you using the e-mail address or phone number in your account. Your credit or debit card will normally not be charged if we reject an initiated payment or order and will only be charged by the appropriate amount if we limit an order.

Refund on Payment transactions

Payments made through Waya Product & Services to a Waya Merchant are subject to Waya’s refund policy. For a complete explanation of the refund policy, please see Refund Policy section below.

Termination of Use of our Product & Services

Waya may, in its sole discretion, terminate your account or your use of Waya Product & Services at any time. You are personally liable for any money transfers you initiate, payments that you make and charges that you incur prior to termination.

Waya reserves the right to change, suspend or discontinue all or any aspects of Waya Product & Services at any time without prior notice.

Refund Policy

Waya keeps detailed logs of all transactions that take place. Waya will conduct a detailed investigation of all refund requests for prepaid services. In cases where it is possible to "return" the services already paid we will endeavor to process a return subject to the Waya Merchant whose service(s) was prepaid for.

For users making payments using Waya:
Waya supports the ability to refund charges made to your account, either in whole or in part. If the original charge underwent currency conversion, the refunded amount is converted back using the same process. There are no fees to refund a charge, but the fees from the original charge are not returned.

For Waya Merchants issuing refunds on payments received through their Waya account:
We submit refund requests to your customer’s bank or card issuer or mobile money wallet immediately. Your customer may see the refund as a credit approximately 5-10 business days later, depending upon the bank. Once issued, a refund cannot be canceled. Disputes and chargebacks aren’t possible on credit card charges that are fully refunded.
We’ll also send an email to your customer notifying them of the refund, if customer made payment through the Waya app and is duly registered as a Waya User.
